IMPLIKASI UNDANG-UNDANG ADMINISTRASI KEPENDUDUKAN TENTANG PENGHAYAT KEPERCAYAAN MENURUT PUTUSAN MK NO. 97/PUU-XIV/2016 (KOLOM AGAMA DI E-KTP)

Penghayat kepercayaan masih mengalami diskriminasi terkait Pencantuman kolom agama di E-KTP. Dalam hal administrasi kependudukan, posisi sebagai penghayat kepercayaan, penganut leluhur dan pelaksanaan ritual adat membuat mereka dipersulit untuk mendapat dokumen-dokumen pribadi seperti kartu tanda penduduk (KTP) elektronik, keluarga (KK), akte nikah, kelahiran. Berdasarkan pasal Undang-undang Administrasi Kependudukan yang menyatakan bahwa agamanya (KK) maupun elektronik bagi tidak isi. Secara fundamental ini disebabkan aliran belum diakui sebagaimana halnya agama-agama lain, sehingga dalam ada catatan seseorang adalah kepercayaan. Bahwa dengan demikian secara faktual atau setidak-setidaknya pontesial merugikan hak-hak konstitusional. Di sisi perlakuan dapat dilakukan siapa saja mempunyai kesadaran tentang hak asasi manusia. Kasus-kasus terhadap tertentu, bahkan birokrasi negara walaupun UUD 1945 telah menjamin kebebasan warga menganut serta menjalankan masing-masing. Perlakuan juga oleh elit kelompok masyarakat tertentu.
